NATIONAL ENVIRONMENTAL MANAGEMENT AIR QUALITY ACT (39/2004) - REPEAL OF SMOKE CONTROL REGULATIONS AND THE SMOKE CONTROL ZONE ORDERS

NATIONAL WATER ACT (36/1998) - REGULATIONS FOR THE USE OF WATER FOR EXPLORATION AND PRODUCTION OF ONSHORE NATURALLY OCCURRING HYDROCARBONS

The Minister of Human Settlements, Water and Sanitation has given notice of her intention to make Regulations for the use of water for exploration and production of onshore naturally occurring hydrocarbons that require stimulation, including hydraulic fracturing and underground gasification, to extract, and any activity incidental thereto that may impact detrimentally on the water resource, in terms of section 26(1)(g) of the NWA read together with GN 999 of 16 October 2015.

The purpose of these Regulations is to prohibit the production, distribution, import, export, sale and use of the substances contemplated in Regulation 3, which include but are not limited to: Hexabromocyclododecane; Hexachlorobutadlene; Polychlorinated naphthalenes; Short-chain chlorinated paraffins.

The Minister of Forestry, Fisheries and the Environment has identified, in terms of Sections 24(5)(a) and (b) of the NEMWA and Regulation 15(2) of the EIA Regulations, 2014, as amended, procedures to be followed when applying for or deciding on an environmental authorization for the development or expansion of below ground gas transmission pipeline infrastructure when occurring in Strategic Gas Pipeline Corridors.
