NATIONAL ENVIRONMENTAL MANAGEMENT: BIODIVERSITY ACT (10/2004): LISTS OF MARINE SPECIES THAT ARE THREATENED OR PROTECTED, RESTRICTED ACTIVITIES THAT ARE PROHIBITED AND EXEMPTION FROM RESTRICTION

The Minister of Environmental Affairs has in terms of -

• Section 56(1) of the NEM:BA, published a list of marine species that are threatened or in need of protection;
• Section 57(2) of the NEM:BA, published a list of prohibited restricted activities; and
• Section 57(4)(a) of the NEM:BA, published a list of persons exempted from the prohibition of undertaking restricted activities as provided for in section 57(1) of the NEM:BA.

The Minister of Environmental Affairs has furthermore, in terms of sections 97(1)(b), (dA), (f), (fA), (g) and (h) of the NEM:BA, made regulations relating to listed threatened or protected marine species.
