NATIONAL ENVIRONMENTAL MANAGEMENT: AIR QUALITY ACT (39/2004): NOTICE REQUESTING FOR PUBLIC COMMENTS ON THE DRAFT NATIONAL CLIMATE CHANGE ADAPTATION STRATEGY

The Minister of Environmental Affairs has, by notice in the Government Gazette, published the draft National Climate Change Adaptation Strategy (NCCAS) for public inputs and comments.
 
South Africa’s NCCAS is intended to be the cornerstone for climate change adaptation in the country and to reflect a unified, coherent, cross-sectoral, economy-wide approach to climate change adaptation. It outlines priority areas for adaptation, both to guide adaptation efforts and to inform resource allocation.

MARINE SPATIAL PLANNING ACT, (16/2018)

The President of the Republic of South Africa, has assented to the enactment of the Marine Spatial Planning Act, 2018 which will come into effect upon proclamation by the President.
The Act aims to inter alia:

a) develop and implement a shared marine spatial planning system to manage a changing environment that can be accessed by all sectors and users of the ocean; 
b) promote sustainable economic opportunities which contribute to the development of the South African ocean economy through coordinated and integrated planning;
c) conserve the ocean for present and future generations; and
d) facilitate responsible use of the ocean.

DEPARTMENT OF ENVIRONMENTAL AFFAIRS AND DEVELOPMENT PLANNING: DRAFT WESTERN CAPE BIODIVERSITY BILL, 2019

MINE HEALTH AND SAFETY ACT (29/1996): GUIDANCE NOTE ON MEDICO-LEGAL INVESTIGATIONS OF MINE DEATHS

The Chief Inspector of Mines, has by notice in the Gazette, published the guidance notes on medico legal investigations of mine deaths in terms of the Mine Health and Safety Act. The objective of the guidance note is to improve the understanding of the legal obligations that relate to medico legal autopsies and to clarify the roles and responsibilities associated with the handling of deaths that occur in the mining industry.

NATIONAL ENVIRONMENTAL MANAGEMENT: AIR QUALITY ACT (39/2004): STRATEGY TO ADDRESS AIR POLLUTION IN DENSE LOW-INCOME SETTLEMENTS

The Minister of Environmental Affairs, has published a strategy to address air pollution in dense low- income settlements, for implementation.
 
The goal of the strategy is to map out the path that the country needs to take in reducing the impact of air pollution in dense low-income settlements. It aims to provide a coordinated approach in implementation of efforts directed at ensuring that ambient air quality in dense low-income settlements is following the National Ambient Air Quality Standards, thereby ensuring the right to air that is not harmful to people’s health and well-being as required by section 24 of the Constitution of South Africa.

The Minister of Environmental Affairs has published, Pursuant to Government Notice 687 the following section of the amendment effected to category 1 sub-category 1.1 (iii) of the minimum emission standards (MES) which were published in GN 1207 of 31 October 2018 is deleted:

1. Definitions

In this Schedule "the List means the List of activities and associated minimum emission standards identified in terms of section 21 of the National Environmental Management Air Quality Act, 2004 (Act No. 39 of 2004), published under Government Notice No. 893 in Gazette No. 37054 of 22 November 2013 and amended by Government Notice No. 551 of Government Notice in Gazette No. 38863 and Government Notice No. 1207 in Gazette No. 42013 on 31 October 2018.

2. Amendment of the Category 1 of the List

Part 3, Category 1, Subcategory 1.1 of the List is hereby amended by the addition of the following special arrangement under subparagraph (a) after item (ii):
"(iii) Existing plants shall comply with a new plant emission limit of 1000 mg/Nm3 for Sulphur dioxide (SO2),"
In terms of Government Notice 686, the Minister proposes amendments to the aforementioned sub category for public comment under section 21(4)(a) read with sections 57(1) and (2) of the NEM: AQA by re-inclusion of the abovementioned deleted section in toto.
Members of the public, were within 30 days of publication of the above notices, required to submit their written comment on or objection to the abovementioned proposed amendments.

The identified area covers the entire Kalahari Gemsbok National Park situated in the Gordonia Registration Division, Northern Cape Province and also form part of the Kgalagadi Transfrontier Park, which is bordered by Botswana and Namibia in the east and west, respectively.

The Nyandeni Local Municipal Council has enacted its Local, Municipal Health By-law. The purpose of these By-laws is to enable the Council to protect and promote the long-term health and well-being of people in the Nyandeni area by: providing, in conjunction with other applicable legislation, an effective legal and administrative framework within which the Council can manage and regulate activities that have the potential to impact adversely on public health; and require premises to be properly maintained and managed; and clearly defining the rights and obligations of the Council; and the public in relation to this purpose.

The regulation of the provision of the municipal service by a service provider and commercial services by licensees; and enhancing sustainable development. In pursuing the main objects of these By-laws, and in particular the object set out in subsection (1)©, the Council must endeavor to minimize the consumption of natural resources, promote the re-use and recycling of waste encourage waste separation to facilitate re use and recycling promote the effective resourcing, planning and delivery of the municipal service and commercial services endeavor to achieve integrated waste planning and services on a local basis promote and ensure an environmentally responsible municipal service and commercial service and endeavor to ensure compliance with the provisions of these By-laws.
