NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT (59/2008): CALL ON THE PAPER AND PACKAGING INDUSTRY, ELECTRICAL AND ELECTRONIC INDUSTRY AND THE LIGHTING INDUSTRY TO PREPARE AND SUBMIT INDUSTRY WASTE MANAGEMENT PLANS TO THE MINISTER FOR APPROVAL

The Minister of Environmental Affairs has, in terms of section 28(1) read with section 31 of the NEM:WA, required the Paper & Packaging Industry, the Electrical and Electronic Industry and the Lighting Industry to prepare and submit industry waste management plans for approval.

The notice provides, inter alia, that -

  • A producer must register with and subscribe to at least 1 industry waste management plan approved by the Minister in terms of section 32 of the NEM:WA that is applicable to them within 1 month after the date of approval of the industry waste management plan or as soon as the producer comes into existence after the approval of the industry waste management plan;
  • Producers operating on the date of publication of this notice must register with the Minister within 2 months after the date of publication of this notice while producers commencing business after the date of publication of this notice must register within 30 days prior to commencing business; and
  • A producer can either prepare and submit an industry waste management plan to the Minister within 9 months from the date of publication of this Notice, or subscribe to an industry waste management plan submitted to the Minister. A producer must comply with the industry waste management plan once it has been approved by the Minister.
