Gerhardt has been involved in litigation for 20 years, since his admission as an attorney in 1996. He spent nine years specializing in criminal law, during which period he honed his court craft and cross-examination skills as he was required to appear in court on behalf clients on an almost daily basis.   He has practised as a defendant attorney, representing practitioners in clinical negligence claims, regulatory matters, inquests, labour disputes and criminal cases since he joined the Cape Town office of MacRobert attorneys in 2003.  Gerhardt was appointed as a director of MacRobert attorneys in 2007.

Gerhardt has developed particular knowledge of the legislation, ethical rules and guidelines relating to perverse incentives, questionable billing arrangements and appropriate business practices for practitioners and has represented medical practitioners, in person, at professional conduct enquiries held by the Health Professions Council South Africa involving a wide range of allegations. These have included allegations of professional negligence, sexual misconduct, fraud and billing irregularities.

Gerhardt is regularly invited to present papers on legal and healthcare-related topics at national conferences, local workshops and local CPD seminars.

Adriaan qualified with a B.Com (Law) degree and an LLB degree from the University of Pretoria. He served his articles with MacRobert Attorneys and was admitted as an attorney in February 2008. He is also a qualified notary public and conveyancer. Ahmed completed his schooling in Dublin, Ireland. Upon his return to South Africa he enrolled at UNISA for a law degree, while concurrently serving his articles at a large law firm in Pretoria. He qualified as an attorney in 1985 and in the same year he and two partners opened the first multi racial law practice in Pretoria. After a very successful career in private practice he joined MacRobert in 2008 as director.

Ahmed is a specialist in the areas of corporate litigation, insolvency law and company law and he is also on the Master of the High Court’s panel as a trustee and liquidator. 
His expertise in litigation has led to his appointment to the bench to preside as acting judge on two occasions, he also sits as an Arbitrator in commercial disputes and commissioner for SARS in Tax Board hearings.

Alison started her career as a paralegal in the property division of a large firm where she gained her practical experience before graduating with an LLB degree from the University of the Western Cape in 2009. Alison has experience in property development and other aspects of conveyancing including deeds registration, mortgage bond registrations, sectional title transactions and notarial agreements.

Anikha obtained a Bachelor of Arts undergraduate degree, majoring in Political Science, Public Administration and Historical Studies, from the University of Cape Town in 2008. She completed her LLB degree in 2012, with refugee law, environmental law and competition law as electives, at the same institution. In April 2012, Anikha was appointed as a candidate attorney in the Corporate Law and Litigation Department of MacRobert Incorporated, Cape Town. Charl is an experienced High Court litigator who specialises in franchise law and intellectual property law. As corporate lawyer he routinely represents financial institutions, franchisors, media owners and other local and international corporate entities. He obtained his B.Iur and LLB degrees from the University of Pretoria. He was the founding director and proprietor of the law firm Groenewald Van Dyk Incorporated at which he practised for almost 10 years. During 2011 he moved his practice to MacRobert where he joined the firm as a director in our corporate division. Charl is well versed in all aspects of commercial law, including the law as it applies to insolvencies, information technology and entertainment. He is also legal counsel to a number of the most recent film productions.

Gustaf obtained his LLB degree from the University of Pretoria, where after he completed 2 years of articles at a prominent law firm in Pretoria. He was admitted as an attorney during May of 2010 and subsequently obtained right of appearance in the High Court of Pretoria. To date hereof he boasts 8 years post admission experience in litigation. Gustaf joined the MacRobert’s Professional Indemnity Department as an associate in April 2011 and thereafter transferred to the Personal Injury Department, where he was also successively promoted to a Director. His focus of practice is in personal injury claims, consisting of but not limited to, third party claims, wrongful arrest, slip and fall claims, dog bite claims and insurance law.

Jayashree is an admitted attorney with a right of appearance in the High Court of South Africa. She joined the MacRobert team in 2012 in the Durban office and currently specializes in Professional Indemnity litigation.  She has thorough knowledge of medico-legal matters and has extensive experience in general High Court Civil litigation which she gained from working for several years at both Plaintiff and Defendant practices. She has a thorough knowledge of professional liability and personal indemnity insurance and has represented and assisted members of the Medical Protection Society with various matters pertaining to clinical negligence claims. Jayashree also assists medical practitioners in responding to complaints lodged via the Health Professions Council of South Africa and has a broad knowledge of the regulations governing medical practice. Jayashree’s day to day practice includes providing advice and support to medical practitioners involving general aspects of medical practice and procedure, legal rights and obligations together with conduct and ethical issues. Jeanne obtained the degrees B Iuris and LLB from the University of the Free State. She served articles with Adams and Adams, where her interest in personal injury work was kindled. After her admission as an attorney and notary in 1993, she joined Couzyns for a short while. However, she left them for a position with Cuzen and Woods where she was exposed to medical malpractice litigation.

Jeanne joined the MacRobert medical malpractice department during 1999 where she has been working ever since. She was appointed as a director of the firm in 2007. She is also admitted as a conveyancer.

He served his articles with Van Velden Duffey Incorporated where his interest in litigation was harnessed. After his admission in 2004, he worked in the financial services sector where he gathered extensive experience and exposure in compliance, legal risk and business management. Jerry was also the founding member of Mayaba Attorneys. After obtaining a B. Iuris degree, Jodie began his career at the Pretoria Deeds Office in 1996. He was a Snr. deeds examiner and also involved in presenting training in the field of sectional titles to the Pretoria and Botswana deeds offices and in updating and compiling deeds office records after the Municipal Structures Act came into operation. In 2003 he was awarded the highest merit award for senior examiners. Jodie joined MacRobert Attorneys as a paralegal in 2005 and completed his LLB degree at the University of Pretoria two years later. In 2007 he was admitted as an attorney, conveyancer and notary. He is an ad-hoc lecturer on behalf of LEAD, presenting Conveyancing admission and preparation lectures. Karin qualified with the degrees BCom (Law) and LLB from the University of Stellenbosch. She served her articles at MacRobert Incorporated and thereafter qualified as an attorney and notary public on 5 March 2010. After being admitted as an attorney, she practised in the Medical Department of the Cape Town office until February 2017.

In March 2017, she was appointed as a director in the Medical Department in the Durban office, where she acts for and advices health care practitioners who are involved in litigation or regulatory matters or who are faced with complaints or ethical dilemmas.

Karin regularly presents lectures to a variety of health care practitioners and medical students and contributes to various publications, in particular on topics of medical law and ethics.

Katherine completed her BA and LLB at the University of Kwazulu Natal, Durban, and joined MacRoberts in 2001.  She holds a Certificate in Medical Law (University of South Africa), a Certificate in Corporate Law (Law Society of South Africa); and is a Notary Public.  She became a director of MacRoberts in 2008 where she has been involved in corporate law and litigation, with over fifteen years’ experience of defendant practice in the specialised area of professional indemnity law, particularly as it pertains to medical practitioners.  This includes high value and complex claims such as spina bifida and cerebral palsy cases and the quantification thereof. 

She has also been involved in managing regulatory and disciplinary matters, Reviews and Appeals, complex inquest cases involving multiple practitioners, and criminal trials such as culpable homicide cases against medical practitioners.  She is frequently involved in researching and preparing advices on a variety of topics and concerns to medical practitioners, including general aspects of medical litigation, ethical questions and healthcare issues. She has also, from time to time, been invited to give presentations to interested groups on medico-legal issues, and has written articles for various publications.

Kenneth graduated from the University of Pretoria in 1996 and was admitted as an attorney in 1999. After specialising in environmental law for four years at Moolmans Incorporated, he co-founded the law firm Cameron Cross Incorporated, specialising exclusively in environmental law. During the following ten years, the firm gained reputation nationwide as one of the leading providers of specialist services in environmental law, and later, health and safety law. Kenneth accumulated 12 years of specialist experience and served clients in the mining, industrial, development, nuclear as well as petroleum exploration and production sectors, amongst others. He has published numerous papers and articles, presented courses in aspects of environmental law at the University of Pretoria and assisted Government with the drafting of subordinate legislation. By 2010, he was rated as “leading” in the field of environmental law in South Africa, through independent peer review. Kenneth joined MacRobert as a director in 2013.

Lassie holds a BProc degree from the University of Limpopo, LLB degree from the University of South Africa, a diploma in Leadership, Financial Management and Communication under the auspices of USSALEP, Certificate in Mediation and Arbitration with AFSA and a Certificate in Court-Annexed Mediation with L.E.A.D. He was admitted as an attorney in 1983 and practised in one of the first “black” firms of its size in Pretoria at that time. He was the chairperson of the Law Students’ Council in 1996 while he was at university. Lassie is a founding member of the Democratic Lawyers Congress in Pretoria, which in turn founded the current National Association of Democratic Lawyers (NADEL). He was a member of a technical team established by Nelson Mandela to set up government and administration structures in Limpopo in 1994. Lassie became the first chairperson of the Northern Province Casino and Gambling Board and founding member of the Southern African Gaming Regulators Association. He was a special adviser to the first and second premiers of Limpopo from 1994 up to June 2006 and a member of the Provincial Constitutional Technical Committee that advised and assisted the Constitutional Assembly to draft the new Constitution in South Africa. Lassie became a member of the Judicial Service Commission representing the premiers of Limpopo in the appointment of judges. He was a founder member and director of Mahlangu Attorneys that merged with MacRobert Incorporated in 2015.

Leila completed the degree LLB at the University of Pretoria at the end of 2006.  She then proceeded with an AIPSA diploma in Insolvency Law and Practice in 2007.  She was also admitted as an attorney on 8th of September 2008.  She is currently a part-time  LLM student at the University of Pretoria in Mercantile Law.

Before joining MacRobert, she gained experience at two law firms in Pretoria specialising in High Court and Magistrate's Court Litigation, Labour Law, Administration of Deceased Estates and Insolvent Estates and various other commercial matters.  She was also involved in numerous political trials.

In April 2010 Leila became part of the MacRobert team as a Junior Associate and has gained tremendous knowledge of Commercial and Corporate Litigation.  In December 2012 she was promoted to a Director of the MacRobert team.  She is currently concentrating her practice on Commercial Corporate and Banking Litigation.

High profile matters:
Mahlangu was appointed as the one of the first private attorneys to represent the South African Revenue Service, approximately 10 years ago.  Nelia has been involved in major litigation on behalf of SARS for the past 10 years.  These have included the renowned King matter as well as the Ponzi scheme, known as the Tannenbaum scheme.

Nelia accompanied and represented SARS in tax related matters in Australia with the Australian Tax Office.  She has also successfully represented the ATO in inter alia the ground breaking, recently reported Supreme Court of Appeal matter of M Krok. Reference: Mark Krok and another v CSARS 2015 (6) SA 317 (SCA).

Nelia also acts for the Minister of Public Works and especially defended the well-publicised claims of Nedbank Ltd, pertaining to the sale to a well-known businessman, of the iconic Sanlam Centre in Pretoria City Centre.

Nelia also acted for various role-players in the process leading up to the building of the highly successful Gautrain.  She was involved in successfully negotiating the re-routing of a certain portion of the train, resulting in the abandonment of the expropriation of approximately 150 houses in Muckleneuk, Pretoria.

Included in the long list of achievements in the field of litigation, Nelia also successfully represented Alexander Forbes in the Supreme Court of Appeal against the Road Accident Fund.

Nicola has practised as a litigation attorney since 1992. She joined the Cape Town office of MacRobert in 1995, was appointed as a director in 1998 and has headed up the Cape Town office since 2005. Since joining MacRobert, her practice has focused on representing medical and dental practitioners and psychologists. This has included preparation for and representation during civil claims, inquest hearings, criminal trials and professional conduct inquiries at the Health Professions Council of South Africa.

She has been involved in the preparation of claims which have gone on appeal both to the Full Bench and to the Supreme Court of Appeal and has successfully represented practitioners at appeal proceedings including the landmark case of Truter and Another v Deysel, in 2006 which confirmed that in medical cases, prescription commences to run as soon as the patient sustains harm and not only when the patient secures expert opinion that the practitioner was negligent.

She advocates mediation (especially in matters which are emotionally charged) and has found this to be a useful tool with which to expedite settlement of disputes.

Suzette obtained a BA LLB from the University of Stellenbosch in 1994.  She worked in the Pretoria and Cape Town branches of the RAF until she joined ENS in 1997 where she completed her articles and was admitted as an attorney in 1999.  She next joined MacRobert in 2003 and was promoted to director in 2008 and practices in the field of medical professional indemnity law.  She also holds a Certificate in Medicine and the Law from UNISA.  Suzette has significant experience in the assessment of damages claims and is regularly invited to speak to a wide range of audiences on various aspects of medical law and ethics.
